Engine swap question?

I'm looking to buy a car and the car has engine swap. My question is are their engines that are not legal to have in your car. I know alil about cars and i never understood about engine swaps and the legal part of it. Someone told me that jdm motor(like the h22) will have smog and registration difficulties, what does he mean?
